Nilufar had translated in hospitals, police stations and courtrooms for eleven years, and she had long ago learned the first rule of her profession: she was a window, not a wall. Her task was to let meaning pass through her unchanged, without adding, omitting or softening anything. Whether a doctor was delivering bad news or a witness was describing a crime, her voice remained level and her own feelings remained, as far as possible, at home.
Nilufar o‘n bir yil davomida kasalxonalar, politsiya bo‘limlari va sud zallarida tarjima qilgan va u allaqachon kasbining birinchi qoidasini o‘rgangan edi: u devor emas, deraza edi. Uning vazifasi hech narsa qo‘shmasdan, tushirib qoldirmasdan yoki yumshatmasdan ma’noni o‘zidan o‘zgarishsiz o‘tkazish edi. Shifokor yomon xabar yetkazayotgan bo‘lsinmi yoki guvoh jinoyatni tasvirlayotgan bo‘lsinmi, uning ovozi bir tekis qolar, o‘z his-tuyg‘ulari esa iloji boricha uyda qolardi.
The case that tested this rule began like any other. An elderly woman from a village in the south, Hanifa opa, was appearing in a civil court in a European city, where her late son had lived and worked for many years. His former business partner claimed that the son had owed him a large sum of money, and he wanted it repaid from the small apartment that was now Hanifa opa’s only inheritance. She had travelled for two days to be there, and she spoke no language but Uzbek.
Bu qoidani sinovdan o‘tkazgan ish boshqa har qandayi kabi boshlandi. Janubdagi qishloqdan kelgan keksa ayol Hanifa opa marhum o‘g‘li ko‘p yillar yashab, ishlagan Yevropa shahridagi fuqarolik sudiga kelgan edi. O‘g‘lining sobiq biznes sherigi o‘g‘li unga katta miqdorda qarzdor bo‘lgan deb da’vo qilgan va uni endi Hanifa opaning yagona merosi bo‘lgan kichik kvartiradan undirib olmoqchi edi. U u yerda bo‘lish uchun ikki kun yo‘l bosgan va o‘zbek tilidan boshqa tilda gapirmasdi.
At first the proceedings were routine. Nilufar translated the judge’s questions and Hanifa opa’s answers with her usual precision. Then the partner’s lawyer produced a document, a handwritten note that he claimed proved the debt, and asked Hanifa opa whether she recognised her son’s handwriting. Nilufar translated the question. The old woman looked at the paper for a long time, and then said something quietly, almost to herself.
Dastlab sud jarayoni odatiy kechdi. Nilufar sudyaning savollari va Hanifa opaning javoblarini odatdagi aniqligi bilan tarjima qildi. Keyin sherikning advokati hujjat — qarzni isbotlaydi deb da’vo qilgan qo‘lyozma yozuvni taqdim etdi va Hanifa opadan o‘g‘lining dastxatini taniydimi, deb so‘radi. Nilufar savolni tarjima qildi. Kampir qog‘ozga uzoq tikilib qoldi, keyin deyarli o‘ziga o‘zi pichirlab nimadir dedi.
What she said was this: “My son never wrote his name like this. He always made the first letter with a little loop, like his father taught him. But what does it matter now? He is gone. Let them take the flat.” Nilufar felt the words settle in her chest like stones. She understood immediately that the first part was potentially crucial evidence, and that the second was the voice of grief and exhaustion speaking, not a considered legal position.
U aytgan narsa shu edi: “O‘g‘lim hech qachon ismini bunday yozmagan. U doim birinchi harfni otasi o‘rgatganidek kichkina halqa bilan yozardi. Lekin endi buning nima ahamiyati bor? U ketdi. Kvartirani olishsin.” Nilufar bu so‘zlar ko‘kragiga toshdek cho‘kkanini his qildi. U darhol birinchi qism potensial muhim dalil ekanini, ikkinchisi esa puxta o‘ylangan huquqiy pozitsiya emas, balki qayg‘u va holdan toyganlik ovozi ekanini tushundi.
She also understood the choice in front of her. If she translated everything exactly, the court would hear an elderly woman apparently giving up her claim. If she translated only the first part, she would be doing precisely what she had promised never to do: deciding, on behalf of someone else, which of their words mattered. For perhaps three seconds, which felt much longer, Nilufar said nothing at all.
U oldidagi tanlovni ham tushundi. Agar u hamma narsani aniq tarjima qilsa, sud kampir go‘yo da’vosidan voz kechayotganini eshitardi. Agar u faqat birinchi qismni tarjima qilsa, u hech qachon qilmaslikka va’da bergan ishni aynan bajargan bo‘lardi: boshqa birov nomidan uning qaysi so‘zlari muhimligini hal qilish. Ehtimol uch soniya davomida, bu ancha uzoq tuyulgan bo‘lsa ham, Nilufar umuman hech narsa demadi.
Then she did the only thing she believed she could do honestly. She translated every word, exactly as it had been spoken, including the loop on the first letter and the instruction to let them take the flat. And then, turning to the judge, she added in her own voice: “Your Honour, as the interpreter, I would ask the court to note that the witness appears to be very tired and distressed. It may be appropriate to confirm whether she has understood the consequences of her last remark.”
Keyin u halol qila olaman deb hisoblagan yagona ishni qildi. U har bir so‘zni, xuddi aytilganidek, birinchi harfdagi halqani ham, kvartirani olishsin degan gapni ham tarjima qildi. Keyin sudyaga o‘girilib, o‘z ovozi bilan qo‘shimcha qildi: “Janob sudya, tarjimon sifatida suddan guvoh juda charchagan va iztirobda ko‘rinishini qayd etishni so‘rayman. Uning so‘nggi gapining oqibatlarini tushunganmi yoki yo‘qligini aniqlash o‘rinli bo‘lishi mumkin.”
The judge paused, then called a short adjournment. When the hearing resumed, Hanifa opa, now accompanied by a lawyer appointed by the court, confirmed that she did not wish to abandon her claim. A handwriting expert was later called, and the note was found to be a forgery. Nilufar was not in court for the final judgement; she was translating in a hospital across the city. But a week later, a small parcel arrived at her agency, addressed to “the girl who spoke for me”. Inside was a hand-embroidered scarf and a note, written by a neighbour on Hanifa opa’s behalf: “You did not change my words. You made sure they were heard.”
Sudya bir oz to‘xtab, qisqa tanaffus e’lon qildi. Sud majlisi qayta boshlanganida, endi sud tayinlagan advokat hamrohligidagi Hanifa opa da’vosidan voz kechishni xohlamasligini tasdiqladi. Keyinchalik dastxat bo‘yicha ekspert chaqirildi va yozuv soxta ekani aniqlandi. Nilufar yakuniy hukm o‘qilganda sudda emas edi; u shaharning narigi chetidagi kasalxonada tarjima qilayotgan edi. Lekin bir hafta o‘tib uning agentligiga “men uchun gapirgan qizga” deb yozilgan kichik posilka keldi. Ichida qo‘lda kashta tikilgan ro‘mol va qo‘shnisi Hanifa opa nomidan yozgan xat bor edi: “Siz so‘zlarimni o‘zgartirmadingiz. Siz ular eshitilishiga ishonch hosil qildingiz.”
